General Conditions of Use (GCU)

I) About us

The company JOURS DE PASSIONS, SAS, with a share capital of 167,000 euros, whose registered office is located in PARIS (75008), at 122 rue du Faubourg Saint-Honoré, is registered in the Paris Trade and Companies Register under number 80 245 296 and is represented by Monsieur Gerbert RAMBAUD (and is hereinafter referred to as the “Company“). The Company markets the following products to its Customers via its Website: Publishing of magazines and periodicals.


The Company invites Users to carefully read these General Terms and Conditions of Use (hereinafter referred to as the “T&Cs”). The validation of a vote implies acceptance of the T&Cs. The characteristics of the Products are indicated on the Website. It is the Customer’s responsibility to take this into account before making a purchase. Any photographs or graphics presented on the Website are non-contractual.

The Customer acknowledges having read and accepted them by checking the box provided for this purpose before submitting his or her Validation of Vote.

The T&Cs govern the conditions under which the Company offers the option of voting to its Professional Customers and Consumers via its Website.

They apply to all votes validated by the Company and are binding on any contradictory documents.

They will be systematically communicated to the Customer on request.

In the event of a subsequent modification of the T&Cs, the Customer is subject to the version in force at the time of the validation of his or her vote.

Definition of terms

 “Customer” refers to the Professional or Consumer who has placed an Order for a Product sold on the Website;

 “Voting Validation” means any vote validated by the User on this Website;

 “General Terms and Conditions of Use” or “T&Cs” refers to these online general terms and conditions of use;

 “Consumer” refers to the buyer who is a natural person and who is not acting for professional purposes and/or as part of his or her professional activity;

 “Professional” refers to the buyer who is a legal entity or private individual acting within the framework of his or her professional activity;

 “Website” refers to this Website, i.e. ;

 “Company” means the Company JOURS DE PASSIONS, more fully described in Article I hereof; and

 “User” refers to any person who uses the Website.

II) Amendments

The Company reserves the right to modify the Website, the T&Cs and any other element of the services provided by the Company through this Website.

When a vote is validated, the User is subject to the provisions set out in the T&Cs in force at the time of the Validation of the vote.

III) Processing of personal data

The use of the Website entails the processing of the Customer’s personal data. If the Customer declines to have his or her data processed, he or she is requested to refrain from using the Website.

This processing of personal data is carried out in accordance with the General Data Protection Regulations of the European Union, number 2016/679, dated April 27th 2016.

In addition, in accordance with the French Data Protection Act of January 6th 1978, the Customer has the right to request access to, change, rectify, modify and oppose any or all of his or her personal data at any time, in writing, by mail and with proof of his or her identity, to the following address: .

IV) Sharing of collected data

The Website may use third-party companies to perform certain operations. By browsing the Website, the Customer accepts that third parties may have access to his or her data to ensure the proper functioning of the Website.

These third-party companies have access to the data collected only for the purpose of performing a specific task.

The Website remains responsible for the processing of this data.

In addition, the User may therefore receive information or commercial propositions from the Company or from its partners.

The User may at any time object to the receipt of such commercial propositions by writing to the Company at the address indicated above, or by clicking on the link provided for this purpose in any e-mails received.

In addition, Customer information may be transmitted to third parties without their express prior consent in order to achieve the following purposes:

  • complying with the law
  • protecting any person from bodily harm or even death
  • fighting against fraud or harm to the Company or its users
  • protecting the Company’s property rights.

V) Data protection

The Company ensures an appropriate level of security proportionate to the risks incurred and their probability, in accordance with the General Data Protection Regulations of the European Union, number 2016/679 dated April 27th 2016.

However, these measures do not constitute a guarantee and do not commit the Company to a performance obligation regarding data security.

VI) Cookies

To enable its Users to benefit from optimal browsing on the Website and better functioning of the various interfaces and applications, the Company may install a cookie on the User’s computer. This cookie makes it possible to store information relating to browsing on the Website, as well as any data entered by Users (in particular searches, logins, emails, passwords).

The User expressly authorizes the Company to place a file known as a “cookie” on the user’s hard drive.

The User has the option to block, modify the storage period, or delete this cookie via the interface of his or her browser. If the systematic deactivation of cookies on the User’s browser prevents him or her from using certain services or features of the Website, this malfunction shall in no way constitute damage to the User, who shall not be entitled to any compensation as a result.

VII) Liability

The Company cannot under any circumstances be held liable for the unavailability, whether temporary or permanent, of the Website and although it uses all means available to ensure the service at all times, it may be interrupted at any time. In addition, the Company reserves the right, by a voluntary act, to make the Website unavailable in order to carry out any update, improvement or maintenance operation.

As previously mentioned herein, in no event shall the Company be liable for delays in delivery for reasons beyond its control, or which are unforeseeable and unavoidable or for which it cannot be held responsible.

VIII) Intellectual property

The brand, logo and graphic charter of this Website are trademarks, registered with the INPI (the French National Institute of Industrial Property), and are intellectual works protected by copyright, the ownership of which belongs exclusively to the Company. Any distribution, use, representation, reproduction, whether partial or complete, without the express authorization of the Company will expose the offender to civil and criminal proceedings.

IX) Jurisdiction

The law governing the T&Cs is French law. Any dispute that may arise between the Company and a User during the execution of the present terms and conditions shall be the subject of an attempt to seek an amicable resolution. Failing this, any disputes will be brought before the competent courts of common law.

X) Acceptance of the T&Cs

The Customer or User expressly accepts the T&Cs.

The Customer declares that he or she is aware of this and waives the right to rely on any other document, in particular his or her own general terms and conditions of purchase.

The Consumer acknowledges that he or she has been informed of the information and data provided for in Articles L. 111-1 to L. 111-7 of the French Consumer Code, and in particular:

  • the essential characteristics of the Product;
  • the price of the Products;
  • the date or period by which the Company undertakes to provide the Service;
  • information relating to the Company’s identity (postal, telephone, electronic contact details);
  • information relating to legal and contractual guarantees and their implementation;
  • the possibility of recourse to conventional mediation in the event of a dispute;
  • information relating to the right of withdrawal (timescale and means of executing).
